The furnished rental market, which is booming, particularly in city centers, has been severely criticized by the Commission on Unfair Terms. This public body, affiliated with the National Consumer Institute, has just published a list of 43 clauses deemed unfair, which it recommends be removed from lease agreements.
Among the most common abuses: some clauses oblige the tenant to leave their accommodation available for viewing during their holidays, others authorize the landlord to carry out work at any time, or even to charge the tenant, in addition to the rent, for taxes and duties relating to the rented property, which are normally the responsibility of the landlord…
These new recommendations are expected to fuel debates surrounding the Duflot housing bill, which begins to be discussed in Parliament this Tuesday. This bill notably aims to establish a rent control system for furnished rentals, which until now have been exempt. Another anticipated measure: the security deposit, freely set by the landlord, should now be limited to two months' rent.
